1. Agreement to Terms

By accessing or using Pummel Vision ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.

2. Description of Service

Pummel Vision is a web-based application that allows users to create video montages from their photos. The Service integrates with Google Photos to access your photos and uses automated processing to generate videos based on your selections and preferences.

The Service may include various features such as:

  • Photo selection from connected Google Photos accounts
  • Automated video creation with various styles and transitions
  • Video storage and management
  • Sharing capabilities for created videos

3. Account Registration and Security

To use certain features of the Service, you must sign in using your Google account. By signing in, you:

  • Represent that you are at least 13 years of age
  • Agree to provide accurate and complete information
  • Are responsible for maintaining the security of your account
  • Must notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content and Intellectual Property

4.1 Your Content

You retain all ownership rights to the photos and videos you create using the Service ("User Content"). By using the Service, you grant us a limited, non-exclusive license to:

  • Access your photos temporarily for video creation
  • Store and serve your created videos
  • Display public videos on our platform
  • Create thumbnails and previews of your content

4.2 Content Responsibility

You represent and warrant that:

  • You own or have the necessary rights to use all content you provide
  • Your content does not infringe on any third-party rights
  • Your content complies with all applicable laws

4.3 Our Intellectual Property

The Service, including its original content (excluding User Content), features, and functionality, is owned by Pummel Vision and is protected by copyright, trademark, and other intellectual property laws.

5. Acceptable Use Policy

You agree NOT to use the Service to:

  • Upload or create content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Create content that promotes violence, discrimination, or hatred
  • Upload content that infringes on intellectual property rights
  • Create or distribute content depicting minors in inappropriate situations
  • Impersonate any person or entity
  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Use automated means to access the Service (bots, scrapers, etc.)
  • Circumvent any access controls or usage limits
  • Resell or redistribute the Service without permission

We reserve the right to remove any content and terminate accounts that violate these guidelines.

6. Service Availability and Modifications

We strive to provide reliable service but cannot guarantee uninterrupted availability. We reserve the right to:

  • Modify, suspend, or discontinue any part of the Service
  • Impose limits on certain features or restrict access
  • Perform maintenance that may temporarily affect availability
  • Change pricing, features, or terms with notice

We will make reasonable efforts to provide notice of significant changes.

7. Third-Party Services

The Service integrates with third-party services, including but not limited to:

  • Google (authentication and Google Photos API)
  • Cloud storage and processing providers

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the content, privacy practices, or availability of third-party services.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PUMMEL VISION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or goodwill
  • Service interruption or computer damage
  • Cost of substitute services
  • Any damages resulting from your use of the Service

Our total liability for any claims related to the Service shall not exceed the amount you paid us, if any, in the twelve (12) months prior to the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless Pummel Vision, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any rights of another party

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your account and associated content
  • Provisions that should survive termination will remain in effect

You may terminate your account at any time by contacting us or using account deletion features.

12. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved as follows:

  • Informal Resolution: We encourage you to contact us first to resolve any dispute informally.
  • Governing Law: These Terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions.
  • Jurisdiction: You agree to submit to the personal jurisdiction of the courts located in Delaware for resolution of any disputes.

13. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and Pummel Vision regarding the Service.
  • Severability: If any provision is found unenforceable, the remaining provisions will continue in effect.
  • Waiver: Failure to enforce any right does not constitute a waiver of that right.
  • Assignment: You may not assign these Terms without our consent. We may assign our rights without restriction.
  • Force Majeure: We are not liable for failures due to circumstances beyond our reasonable control.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
